General Conditions of Sales

These terms govern all sales made through our online and in-store store, defining the rights and obligations of each party in these transactions.

1. Purpose

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions under which Motorsport Corner, including the activities of La Baule Collector, offers for sale and delivers to its customers (hereinafter referred to as “the Customer”) products related to the world of automobiles. These products include, but are not limited to:​

  • Automotive Artworks

  • Vintage Photographs​

  • Posters​

  • Autographs

  • Scale Models​

  • Lithographs​

  • Books​

  • Collectibles​

The purchase of these products, whether online via our website or directly in-store, implies the Customer’s unconditional acceptance of these General Terms and Conditions.​

 

2. Products and Availability

Our products are offered for sale while stocks last. Each item is described in detail, including photographs and specific information designed to best inform the Customer of the essential characteristics of the product. However, these photographs are provided for informational purposes only and may not perfectly reflect the actual condition of the product, particularly with regard to colors or dimensions.

If a product is unavailable after the order has been placed, we undertake to inform the Customer as soon as possible. The Customer will then have the option of replacing the product with another of equivalent quality and price, or canceling the order with a full refund of the amounts paid.

3. Price

The prices of our products are indicated in euros (€) and are inclusive of all taxes (TTC), including the value-added tax (VAT) applicable on the date of the order. These prices do not include delivery charges, which will be specified to the Customer during the order process and added to the total amount payable.

Motorsport Corner reserves the right to modify its prices at any time, without prior notice. However, products will be invoiced based on the rates in effect at the time the Customer confirms the order. In the event that an incorrect price is displayed, which is clearly derisory compared to the actual value of the product, the order may be canceled, even after initial confirmation.

4. Order

Placing an order on our website or in-store constitutes firm and definitive acceptance of these General Terms and Conditions. The online ordering process includes the following steps:

  1. Product selection: The Customer adds the products he wishes to purchase to his basket.

  2. Validation of the basket: The Customer checks the contents of their basket, the total price of their order and can make changes if necessary.​

  3. Identification: The Client creates an account or logs into their personal space by providing accurate and up-to-date information.​

  4. Choice of delivery method: The Customer selects the desired delivery method from the options offered.

  5. Choice of payment method: The Customer chooses the payment method from those offered.
    ​

  6. Validation of the order: After having read these General Terms and Conditions and having accepted them, the Customer definitively validates his order.​

  7. Order confirmation: A confirmation email summarizing the order details is sent to the Customer.​

Motorsport Corner reserves the right to refuse or cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order, or if the information provided when ordering proves to be inaccurate or fraudulent.

5. Payment

Payment for purchases is made in cash when ordering. We accept the following payment methods:

  • Bank card: Visa, Mastercard, American Express. Credit card payments are secured using the SSL (Secure Socket Layer) protocol, guaranteeing data confidentiality and integrity.

  • PayPal: The Customer can use their PayPal account to pay for their order securely.
    ​

  • Apple Pay: Available to Apple device users, this payment method offers a fast and secure experience.
    ​​

In the event of refusal by the banking institution, the order will be automatically cancelled and the Customer will be informed by email. The products remain the property of Motorsport Corner until full payment of the price.

6. Delivery

Ordered products are delivered to the address provided by the Customer when placing the order. It is therefore essential that the Customer ensure the accuracy of the information provided to avoid any delays or delivery errors.

 

7. Right of withdrawal

In accordance with the provisions of Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the products to exercise their right of withdrawal, without having to provide a reason or pay a penalty.

To exercise this right, the Customer must notify their decision in writing to the email or postal address listed on our website, specifying their order reference. The products must be returned in perfect condition, in their original packaging, and at their expense, no later than 14 days after sending the withdrawal notification.

Exceptions: In accordance with Article L221-28 of the French Consumer Code, this right of withdrawal does not apply to personalized or custom-made products, such as certain signed works, numbered prints, or custom frames.

 

8. Legal guarantees

All products sold by Motorsport Corner benefit from legal guarantees:

  • Guarantee of conformity (articles L217-3 to L217-20 of the Consumer Code): the goods delivered must conform to the description given and present the qualities that the consumer can legitimately expect.

  • Guarantee against hidden defects (articles 1641 to 1649 of the Civil Code): in the event of a defect rendering the goods unfit for their normal use, the Customer may request repair, replacement or reimbursement.

The Customer has a period of two years from delivery of the goods to assert these guarantees.

 

9. Responsibility

Motorsport Corner cannot be held liable for any indirect damages that may arise from the purchase of its products. Similarly, it cannot be held liable for any inconvenience or damage inherent in the use of the Internet (data loss, intrusion, viruses, service interruption, etc.).

Motorsport Corner can only be held liable in the event of proven fault attributable exclusively to it.

 

10. Intellectual property

All visual, audio, textual, and software elements of the website www.motorsportcorner.com and related materials (photos, logos, illustrations, descriptions, videos, etc.) are protected by intellectual property law.

Any total or partial reproduction, modification, or use of these elements for any purpose whatsoever without our express written permission is strictly prohibited.

 

11. Personal data

Personal data collected during orders or account creation is intended exclusively for Motorsport Corner and La Baule Collector to ensure the proper management of business relationships.

This data is processed in accordance with the General Data Protection Regulation (GDPR). The Customer has the right to access, rectify, object to, delete, or transfer their data, which they may exercise at any time by submitting a written request.

12. Applicable law and disputes

These General Terms and Conditions are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing an amicable resolution, any dispute will be submitted to the competent French courts, in accordance with the applicable jurisdiction rules.
